THE RAJYA SABHA SECRETARIAT (METHODS OF RECRUITMENTAND QUALIFICATIONS FOR APPOINTMENT) ORDER, 1974
In exercise of the powers conferred by sub-rule (2) of rule 4 and rule 5 of the Rajya Sabha Secretariat (Recruitment and Conditions of Service) Rules, 1957, and in supersession of the Rajya Sabha Secretariat (Methods of Recruitment and Qualifications for Appointment) Order, 1969, and all other orders made by the Chairman in this behalf, the Chairman hereby makes the following Order: -
1. Short title and commencement– (1) This Order may be called the Rajya Sabha Secretariat (Methods of Recruitment and Qualifications for Appointment) Order, 1974.
(2) It shall come into force in the 1st day of December, 1974.
2. Definitions – In this Order, unless the context otherwise requires –
(a) “Chairman” means the Chairman of the Rajya Sabha;
(b) “Secretary-General” means the Secretary-General of the Rajya Sabha;
(c) “Service” means service in the Rajya Sabha Secretariat; and
(d) “the Schedule” means the Schedule to this Order;
3. Methods of recruitment – The recruitment to a post or class of posts mentioned in column 1 of the Schedule shall be made by the method or methods and in the manner specified in a corresponding entry in column 3 of the Schedule, and where more than one such method has been so specified, the proportion of vacancies to be filled by each method shall be such as is specified in the corresponding entry in column 2 of the Schedule:
Provided that the Secretary-General may in any particular case of a post or class of posts vary the proportion of vacancies to be filled by various methods, and may depute an officer from one Service to another Service in the interest of Parliamentary work.
4. Qualifications for appointment – The qualifications required for appointment to the various categories of posts mentioned in column 1 of the Schedule shall be such as are specified in the corresponding entries in column 3 of the Schedule :
Provided that where no qualification is specified for any post or class of posts, the Secretary-General may, by a special or general order, specify the qualifications for that post or class of posts.
*Provided further that where a minimum qualification has been prescribed in the Schedule for a post or a class of posts for direct recruitment, the number of candidates to be called for test/ selection may be restricted after screening to a reasonable number of candidates keeping in view their academic performance and work experience.
5. Variation of proportion of vacancies to be filled by prescribed method –
(1) The proportion of vacancies to be filled by each method indicated in column 2 of the Schedule against a post or class of posts mentioned in column 1 thereof shall, as far as possible, be adhered to:
Provided that wherever a variation has taken place under paragraph 3, necessary steps shall be taken to restore the prescribed proportion by adjusting recruitment thereafter to the post or class of posts to which the proportion relates.
(2) Nothing in sub-paragraph (1) shall apply to the filling by promotion of a temporary vacancy not extending beyond four months, and it shall not be necessary for the appointing authority to adhere to the proportion indicated in column 2 of the Schedule against a post in filling by promotion such a temporary vacancy in that post.
6. Promotion – (1) Where the method of recruitment by promotion has been prescribed in the Schedule –
(a) it shall be made by selection on merit, irrespective of seniority in service;
(b) for purposes of selection under clause (a) of this sub-paragraph, merit in relation to an officer, shall include –
(i) his performance at a test, whether oral or written or both, if such a test is ordered by the appointing authority to be held for the purpose of such selection;
(ii) the reports on his work and conduct by his superior officers;
(iii) the enthusiasm shown by him in the various activities of the Secretariat;
(iv) his academic qualifications;
(v) his previous experience of the particular type of work which he will be required to perform if selected; and
(vi) any other requirement which the appointing authority may lay down for eligibility for such promotion; and
(c) all officers eligible for promotion to a particular grade shall be considered together and not in the order in which they are shown in the Schedule:
Provided that where the number of officers eligible for consideration is large, the appointing authority may lay down further criteria, eg. length of service, academic qualifications, etc. in order to reduce the number of officers to be considered to a reasonable figure vis-à-vis the number of vacancies to be filled as a result of such consideration:
Provided further that subject to availability of suitable candidates belonging to the Scheduled Castes or Scheduled Tribes possessing the qualifications prescribed for appointment, due regard shall be paid to the orders issued by the Central Government from time to time relating to promotion of such candidates by ‘selection’.
(2) For the purpose of calculating the length of service put in by an officer in a grade(s), in cases where a minimum period of service has been prescribed for promotion to the next higher grade(s), the service rendered by the officer concerned before the reorganisation of the Secretariat on the 1st day of December, 1974, in the corresponding post(s)/grade(s) in the Secretariat, may also be taken into account.
*Explanation I – For the removal of doubts it is hereby declared that for the purpose of this sub-paragraph for promotion to the post/grade of Legislative Officer, Protocol Officer, Executive Officer and Committee Officer, the service rendered by an officer in the post/grade of Senior Assistant and Assistant before the re-organisation of the Secretariat on the 1st day of December, 1974, may be taken into account and in making such promotion the seniority of the officer in the grade of assistant before such re-organisation shall be taken into consideration and in conformity with the practice followed in the Secretariat before such re-organisation.
Explanation II - Where for promotion to a post, a minimum service in a particular grade or grades from which promotions to be made, has been prescribed, the service rendered by an officer in the corresponding grades or grades in the Pay & Accounts Office, Rajya Sabha, immediately prior to its merger with the Secretariat with effect from 1st March, 1984, shall also be taken into account in computing the requisite service.
(3) The Secretary-General may, in exceptional cases, relax the period of service prescribed for promotion to a higher grade.
*6A. Appointment to posts not included in the Schedule –
“Subject to the proviso to Clause 4, appointment to posts of Joint Secretary and Additional Secretary shall be made by the Chairman.”
Also, the Secretary-General may make appointments of suitable persons to a post or a class of posts not included in the Schedule, with the approval of the Chairman.
7. Direct Recruitment – Where the method of direct recruitment has been prescribed in the Schedule in the case of a post or class of posts-
(a) the selection shall be made by a test from among persons who possess the qualifications and satisfy the conditions prescribed by or under this Order for appointment thereto;
(b) the Secretary-General shall determine whether the test to be held under clause (a) of this paragraph shall be written, oral or both;
(c) the standard of the written test to be held under this paragraph shall be such as the Secretary-General may, from time to time, by order, prescribe;
(d) the Secretary-General may, if he so considers necessary, prescribe by order any condition regarding experience, age or physical standard to be fulfilled by the candidates or any class of candidates for eligibility for direct recruitment to such post or class of posts in addition to the requirements as to the qualifications for appointment prescribed by or under this Order; and
(e) subject to availability of suitable candidates belonging to the Scheduled Castes or Scheduled Tribes possessing the qualifications prescribed for appointment thereto, due regard shall be paid to the rules relating to reservation of posts for members of such Castes or Tribes in the Central Secretariat.
8. Selection Boards – Subject to the provisions contained in this Order, the Secretary-General may constitute a Selection Board or Boards for recommending to the appointing authority suitable candidates for appointment to a post or class of posts.
9. Appointment to posts for which special type of experience or qualification is required – For purposes of appointment by promotion or otherwise to a post for which a special type of experience or qualification is required, an officer, even though otherwise eligible for appointment to that post under the provisions of this Order, may not be considered for appointment, if the appointing authority is of opinion that he does not possess the required experience or qualification.
10. Age Limit – (1) Unless otherwise prescribed in the Schedule, the age of an officer recruited to a post shall ordinarily be not less than 18 years and not more than 25 years on the date of his appointment, if he is not already serving in connection with the affairs of the Union or of a State.
(2) the Secretary-General may –
(a) in the case where having regard to the higher educational or other qualifications of an officer recruited to a post, he considers it expedient so to do, or
(b) in the case where an officer recruited to a post belongs to the Scheduled Casts or the Scheduled Tribes, relax in respect of such officer the maximum age limit specified in sub-paragraph (1) of this paragraph or prescribed under clause (d) of paragraph 7.
NOTE – If in any special case, Secretary-General exempts an officer from the maximum age limit, the officer concerned shall give an undertaking at the time of recruitment of the fact that the understands that he may not be able to earn full pension.
(3) When the opinion of the Secretary-General an office appointed in the first instance in a temporary capacity to a post is likely to be made permanent in that post at a later date, the question of relaxation of the maximum age limit, if necessary, shall be considered at the time of his first appointment, though formal sanction to the relaxation of the maximum age limit may be accorded at the time the officer is confirmed in the post.
NOTE – In the case of an officer who is below 25 years of age at the time he enters service in a temporary or officiating capacity but is over 25 years at the time of confirmation, the question of relaxation of the maximum age limit does not arise and no formal sanction to any relaxation of the maximum age limit would be required at the time of confirmation.
11. Relaxation of qualifications – (1) The Secretary-General may, from time to time, if he is of opinion that in the interest of Parliamentary work it is expedient so to do, by a special or general order, relax the qualifications prescribed for a post in column 3 of the Schedule.
(2) The Secretary-General may, in the case of an officer who holds a lien on any permanent post in the Secretariat or under the Central Government or a State Government or who has been declared quasipermanent in any post under the Central Government, relax the qualifications prescribed in column 3 of the Schedule for a post to which such officer is appointed by promotion or by permanent transfer or deputation.
(3) The appointing authority may, for the purpose of filling by promotion a temporary vacancy not extending beyond four months in a post, relax the qualifications prescribed in column 3 of the Schedule for that post.
12. Officers in service on the 1st December, 1974 – Notwithstanding anything contained in this Order and the schedule, the claim of each officer who is in service of the Secretariat on the 1st day of December, 1974, shall be taken into consideration for appointment to a post in the Secretariat, on re-organisation from the 1st day of December, 1974 and while considering his claim for appointment to such post, the option, if any, given by him, may be taken into consideration but the appointing authority, shall, in deciding his case, give due regard to his suitability for any particular Service or post, his previous experience in the particular type of work which he will be required to perform if selected for that service or post, his academic qualifications, length of his service in the Secretariat and the reports on his work and conduct by his superior officers.
If any question arises as to any orders under this paragraph, the decision of the Secretary-General shall be final.

Hindi/English Interpreters – Essential Qualifications: -Master’s Degree in Hindi with English language upto degree level or vice-versa. Desirable: -(i) 2 years experience in teaching, translation or interpretation work; (ii) ability to converse and write fluently in the two languages used during Interpretation; and (iii) familiarity with the modern forms and usages in the two languages. II.Regional Language Interpreters Essential Qualifications: -Master’s Degree in English/Hindi with the Regional Language upto Degree level or vice versa. Desirable: - (i) 2 years experience in teaching, translation or interpretation work in regional language & Hindi/English and Degree in Hindi/English; (ii) ability to converse and write fluently in two languages used during Interpretation; and (iii) familiarity with the modern forms and usages in the two languages. Preference may be given to those candidates who can interpret from Hindi to English or vice versa along with Regional Languages. Note: The candidates so selected will have to undergo training in Interpretation for such period as may be specified by this Secretariat. They will also have to qualify in the departmental test with such standard of proficiency in interpretation as may be prescribed. Services of such person who fail to qualify in the test will be terminated without assigning any reason whatsoever. They may be required to perform non-interpretation duties as may be assigned to them from time to time. Age: Below 30 years. |
